Click & Collect - Terms and Conditions
1. Introduction
These Terms and Conditions govern the use of the Cape View Nursery Click & Collect service ("the Service") provided by Cape View Nursery, herein referred to as "Cape View," "we," "us," or "our." By placing a Click & Collect order, you agree to be bound by these terms. Please read them carefully before proceeding with your order.
2. Click & Collect Service
The Click & Collect service allows customers to place orders for nursery products through our website or designated mobile application and collect them from our physical store location.
3. Ordering Process
a. Customers must be at least 18 years of age to place Click & Collect orders.
b. All orders are subject to product availability and confirmation by Cape View.
c. Orders will be processed during Cape View Nursery's operating hours.
4. Product Availability
a. While we strive to maintain accurate inventory information, product availability may vary. We do not guarantee the availability of any specific product.
b. In the event that a product becomes unavailable after you have placed an order, we will notify you as soon as possible and offer a suitable alternative or a refund for the unavailable item.
5. Order Confirmation
a. You will receive an email confirmation once your Click & Collect order is processed and ready for collection.
b. The order confirmation will include the order number and the designated collection location within our store.
6. Collection of Orders
a. Orders must be collected during Cape View Nursery's designated operating hours.
b. To collect an order, customers must present a valid order confirmation email and a government-issued photo ID.
c. If someone else is collecting the order on your behalf, they must provide a copy of the order confirmation email, along with their own photo ID.
7. Order Holds
a. We will hold your Click & Collect order for up to 7 days from the date of the order confirmation.
b. If your order includes any perishable items (e.g. plants or other living products that require specialised care) same day collection is preferred.
c. If you are unable to collect a perishable order same day or the following day please contact the nursery prior to placing your order.
d. If you fail to collect your order within the specified timeframe, we reserve the right to cancel the order and refund the purchase amount minus any applicable fees.
8. Order Amendments and Cancellations
a. Amendments to Click & Collect orders must be requested by contacting our customer service team before the designated collection time & date.
b. With the exception of unforeseen circumstances, including but not limited to technical errors, we will contact you prior to the cancellation of any orders.
9. Refunds and Returns
a. Our standard refund and return policy apply to Click & Collect orders. For details, please refer to our Refund and Return Policy.
b. If you wish to return any items from your Click & Collect order, please follow the instructions outlined in our Refund and Return Policy.
10. Liability
a. Cape View Nursery shall not be held liable for any indirect, consequential, or incidental damages arising from the use of the Click & Collect service, or any products purchased through the service.
b. Cape View Nursery's liability for any direct damages shall be limited to the total amount paid for the Click & Collect order in question.
11. Privacy
Cape View Nursery will handle your personal information in accordance with applicable privacy laws and our Privacy Policy.
12. Amendments
Cape View Nursery reserves the right to amend these Terms and Conditions at any time without prior notice. The most current version will be available on our website or mobile application.
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the Australian Consumer Law guarantees, without regard to its conflict of laws principles.
